RESOLUTION NO. 890 <br />A RESOLUTION APPROVING THE PRELIMINARY PLAT OF. <br />KARL GARDNER <br />2885 SIXTH AVENUE NORTH <br />WHEREAS, the City of Orono is a municipal corporation organized and <br />existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted subdivision <br />regulations for the orderly, economic and safe development of land <br />within the City; and <br />WHEREAS, the Planning Commission has considered this subdivision <br />application, has held a public hearing and has made recommendations to <br />the City Council; <br />NOW, THEREFORE, BE IT RESOLVED, that based upon all of the information <br />presented by the applicant, reports by the City staff, consultants and <br />Planning Commission, and the record of the public hearing held <br />February 27, 1978, the City Council of the City of Orono, after due <br />consideration, hereby approves the preliminary plat for Karl Gardner <br />with the following changes and requirements and conditions': <br />1. The final subdivision must be submitted in the form of a record plat, <br />with at least 2 reproducible mylar_copies, 3 hardshell mounted copies, <br />10 paper copies and one copy reduced to a scale of 1" = 200 ft. <br />2. The private road, "James Town Road", shall be platted as an outlot <br />with an underlying easement to the City. <br />3. Access to Lot 1, Block 13 and Lot 1, Block 2, shall be to the private <br />road and not to CSAH 6. <br />4. Access to Lots 2 and 3, Block 2, from CSAH 6, shall be by common <br />driveway at the existing location. <br />5. The applicant shall execute a quit claim deed to Hennepin County <br />dedicating a 50:0 ft. right-of-way (10.0 ft. more than existing) <br />for CSAH 6 and said dedication shall appear on the plat. <br />6. The applicant shall dedicate on the plat 10 ft. wide drainage and <br />utilities easements along each lot line and shall execute and deliver <br />a drainage and utilities easement document. <br />i:7.. The applicant shall execute and deliver a Homeowner's Association <br />agreement, articles of incorporation and/or bylaws and a road and <br />utilities easement providing for the access, use and maintenance <br />of the private road outlotj or other legal evidence of outlot <br />ownership and maintenance responsibilities. <br />
