RESOLUTION NO. 866 <br />A RESOLUTION APPROVING THE PRELIMINARY PLAT OF <br />JAMES LAWRENCE <br />1550 SIXTH AVENUE NORTH <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision and septic system regulations for the orderly, economic <br />and safe development of land within the City; and <br />WHEREAS, the Planning Commission and City Council have considered <br />the appliciation for a subdivision plat for James Lawrence; <br />NOW, THEREFORE, BE IT RESOLVED, that based upon all of the <br />information presented by the applicant and reports by the City staff, <br />consultants and the Planning Commission, the City Council of the <br />City of Orono hereby approves the preliminary plat for James <br />Lawrence with the following changes and requirements and conditions: <br />1. <br />Drainage plans, easements, cul-de-sac location, <br />erosion control and street gradients shall be <br />approved by the City Engineer. <br />2. <br />Drainage plans and erosion control measures shall <br />be approved by the Minnehaha Creek Watershed District. <br />3. <br />Access shall be by a private road developed within <br />a 50 ft. wide right-of-way with an underlying <br />access easement dedicated to the City and with <br />the location approved by the Hennepin County Public <br />Works Department. <br />4. <br />The Douglas -Dayton subdivision shall first be <br />finally approved and a receipt of recording delivered <br />to the City. <br />5. <br />The new division shall consist of 6 lots (Lots 1, 22 <br />3 and 4 combined, 5 and 6 combined, 7 and 8 as <br />shown on the revised 11-30-77 proposal). <br />6. <br />Further combination of Lots 1 and 2 shall be required <br />if the applicant fails to satisfy the City Engineer <br />with satisfactory septic system site evaluation for <br />said lots. <br />7. <br />The applicant shall execute a 30 ft. wide flowage <br />and conservation easement along the existing Holy <br />• 8. <br />Name. Creek. <br />The applicant shall execute and deliver a road and <br />utilities easement, a developers agreement, and a <br />homeowner's association agreement, articles of <br />incorporation and/or by-laws. <br />
