9. Lot Area Comparison With Neighborhood - Exhibit F shows the existing <br />developed lakeshore lot sizes for the east side of Shadywood Road from <br />County Road 51 to the Coffee Bridge. Existing lot sizes range from 0.22 <br />acres to 1 .00 acres. Lot 21 in question is 0. 35 acres. Of 25 properties <br />in this strip, 11 (or 44%) are equivalent to or smaller than Lot 21. Lot <br />22 in question, with the house, is 0.40 acres. Again, 11 of 25 (or 44%) <br />are equivalent or smaller. Also, overall, 17 of 25 (or 68%) are smaller <br />than 0.50 acre. There are four properties larger than the 0.74 acre of <br />Lots 21 and 22 combined. <br />The average existing density is 0.48 acres/building site (11.89 acres <br />25 properties) excluding the two lots in question. <br />Based on the above, a case can be made either way i.e. a significant <br />percentage of neighboring properties are equivalent or smaller than the <br />proposal; yet the proposal yields two lots significantly smaller than <br />the average lot area. <br />10. Similar Applications Which May Be Precedents - what equival nt <br />applications may have set a precedent for this application? The Lorge <br />properties (3695-2697 Casco Point Road )come to mind, with existing lots <br />of about 0. 48 acres (house ) and 0.44 acres (vacant ) and leaving a setback <br />of ±6' for the existing house. As you are probably aware, this was the <br />subject of a lawsuit which was finally settled in favor of the applicant, <br />allowing construction on the 0.44 acre lot but with no other variances <br />granted. Thedif ferences between the two applications would seem to lie <br />only in the magnitude of the lot area and width variances requested. <br />In the Smiley application, again similar to this, a lot line <br />rearrangement was required in order to create a setback, since the <br />existing house extender: into the vacant lot. <br />This also is very similar to the Douglas Smith application in which a <br />commonly owned lot of .43 acres was approved as a separate building site, <br />but with no setback variance required for the existing house. <br />Lot w/House <br />Variance <br />Vac Lot <br />Variance <br />Lorge <br />0.48 ac <br />0.02 ac or 4% <br />0.44 ac <br />0.06 or 12% <br />Johnstone <br />0.40 ac <br />0.10 ac or 20% <br />0.35 ac <br />0.15 ac or 30% <br />Smith <br />0.71 ac <br />none <br />0.38 ac <br />0.12 ac or 24A <br />Smiley <br />0.65 ac <br />0.35 ac or 35% <br />0.59 ac <br />0.41 ac or 41% <br />.he C'ounci 1 has consistently approved vacant lots as buildable with lot <br />sizes of 0.40 acres, in recent applications with lakeshore and non- <br />lakeshore situations, including: Clifford -- 4760 North Shore Drive, <br />0.39 acres; Brockopp - 993 Wi ldhurst Trail, 0.40 acres; Haapa la - 4015 <br />Dahl Road, 0.39 acres. Alsc a number of smaller lots have been approved <br />for building sites where a house or cabin was previously existing. <br />If this application is approved, it may set a precedent by allowing a <br />common 0.35 acre lot to be declared buildable, hence a cursory review of <br />the LR-IC district indicates a potential of as many as 10 or 15 new <br />building sites might be created from existing common ownership lots that <br />couldn't be built on if required to more closely meet the 1/2 aerf <br />requirement. <br />
