Defendants appear to have treated plaintiffs poorly. In <br />a situation involving granting of a public access to property <br />owned in part by a city official, the City should have taken <br />extraordinary measures to avoid even the appearance of <br />impropriety. Nevertheless, plaintiffs will have to seek <br />their redress in state vourt. <br />Based on the foregoing, IT It ORDERED that plaintiffs' <br />motion for partial summary judgment is denied, and <br />defendants' motion for summary judgment is granted. <br />LET JUDGMENT BE ENTERED ACCORDINGLY. <br />,u ge Harry H.
