..9 <br />of development and services in urbanizing fringe areas around <br />cities. <br />THE AMM REQUESTS THAT NO FURTHER CHANGES BE MADE: IN THE STATUTES <br />GOVERNING THE OPERATION OF THE MTNNESOTA MUNICIPAL BOARD. <br />II-J VETERANS PREFERENCE <br />The basic provisions of the uniform veterans preference law for <br />state and local government have over the years worked reasonably <br />well and except for a few changes to restore employee equity <br />should not be changed. The AMM recommends the legislature review <br />and modify the law as follows: <br />J-1 NO COMPENSATION FOR UNWORKF.D PERIODS <br />WHEN A VETERAN'S EMPLOYMENT IS TERMINATED AND HE OR SHE DOES NOT <br />REQUEST A HEARING WITHIN TEN DAYS, OR WHEN AN IMPARTIAL HEARING <br />BODY DET7RMINES THAT THE DISMISSAL WAS FOR JUST CAUSE, THE LAW <br />SHOULD NOT REQUIRE THAT THE VETERAN RECEIVE COMPENSATION FOR ANY <br />PERIOD WHEN SERVICES WERE NOT ACTUALLY PERFORMED. <br />J-2 ONE HEARING PROCEDURE <br />THE LAW SHOULD MAKE IT CLEAR THAT THE PETIT TO,', PROCEDURE IS AN <br />ALTERNATIVE TO LOCAL ADMINISTRATIVE HEARING. THE HEARING BODY <br />NEED NOT BE THE CIVIL SERVICE COMMISSION (AT ITS OPTION) IN THOSE <br />CITIES THAT HAVE SUCH A COMMISSION. <br />J-3 PROBATIONARY PERIOD <br />THE LAW SHOULD BE MODIFIED TO ALLOW CITIES TO TERMINATE VETERANS <br />THE SAME AS ALL OTEER PERSON DURING THE PROBATIONARY PERIOD <br />WITHOUT HEARING. <br />II-K EMPLOYEE DISABILITY - LOCAL POLICE AND FIRE FUNKS <br />Ift hUmber of cities with local police and firetp6tinsion funds are <br />experiencing a problem with employees receiving disability <br />payments from the local fund and full worker's compensation <br />Payments totalling more in after tax take home pay than if they <br />were working. PERA policy and fire employees are prohibited by <br />law from receiving greater pay while on disability tha&„ while <br />working, but Minnesota Statutes 424.27 specifically prohibits <br />cities with local plans from correcting the above situation. <br />This quirk in the law is a costly one for cities and provides <br />impetus for marginally disabled employees to stay home. Why work <br />when you can make more by not working? Therefore, <br />THE AMM URGES THE LEGISLATURE TO CORRECT MINNESOTA STATUTE 424.27 <br />TO ELIMINATE THE ABILITY OF AN EMPLOYEE IN A LOCAL POLICE OR FIRE <br />-11- <br />
