parked off White Oak Circle and on the construction site <br />property. <br />3. Stress upon White Oak Circle drive due to heavy construction <br />equipment traffic. <br />a. The homeowners li, Qd/signing below have assumed <br />responsibility for mp :fining and repairing White Oak <br />Circle ever, though the drive is owned by the original <br />developer, C.E. Van Eeckhout. We have, in fact, spent <br />$6,400 to dale, in repair and maintenance of the drive. We <br />have also contracted each winter for snow removal. <br />Therefore, we consider White Oak Circle "our drive" even <br />though it is owned by the original developer. <br />b. There is an Fasement Purchase Agreement between the <br />developers, George C. Funk and Judith A. Rogosheske, and <br />C.E. Van Eeckhout, owner of Track I - White Oak Circle. The <br />purchase price is $6,000 for an access and utilities <br />easement. <br />We have experienced damage to the drive in the past by heavy <br />construction machinery being hauled over it. That damage <br />prompted the repair and maintenance cited above. <br />We request that the commission request the subdivision owners to <br />provide a "construction road" on the south side of their <br />property, allowing heavy equipment to pars in and out directly <br />from Old Crystal Bay Road without using the White Oak Circle <br />drive. In the event this is not done, we request that the <br />commission require the $6,000 purchase price of the easement be <br />set aside in escrow to repair whatever damage may result from <br />contractors' use of the street. <br />We also request, in the event heavy construction equipment <br />traverses White Oak Circle drive, that the normal and usual Orono <br />city restrictions as to load limits on city streets in the spring <br />and fall also apply to White Oak Circle. <br />4. Possible Extention of White Oak Circle <br />The present White Oak Circle ends in a cul-de-sac. There is <br />currently a 60 foot road easement which is an extention of White <br />Oak Circle between Plat 4 and Plat H. In the event that this <br />easement is to be used as an access road to any of the developed <br />property, we request, than it be constructed to the same road <br />standards as White Oak Circle and not to ordinary "driveway" <br />standards. The topography of the land, the existing road layout <br />and the present homesites' locations, are such that a simple <br />"driveway" would detract from the beauty and character of our <br />neighborhood. We therefore ask that the present road standards <br />be maintained if White Oak Circle is to be extended past, its <br />present end at the cul-de-sac. <br />
