EASEMENT PURCHASE AGREEMENT <br />WHEREAS JUDITH A. ROGOSHESKE and GEORGE C. FUNK (hereinafter the <br />Buyers), are the owners of the certain property known as TRACT C of Registered Land <br />Survey No. 1340; <br />WHEREAS, VANEECKHOUT BUILDING CORPORATION (hereinafter the Seller), <br />is the fee owner of the certain property known as TRACT I of Registered Land Survey <br />No. 1447; <br />WHEREAS Buyers are interested in subdividing their property including that <br />ACT C, and as that tract abuts Seller's property, TRACT 1, and TRACT I is a <br />-nary access road for entrance to and exit from the property to be subdivided by <br />-Ayers; <br />NOW, THEREFORE, for $1.00 and other good and valuable consideration the <br />sufficiency of which i-. hereby acknowledged, the Buyers agree to purchase, and the <br />Seller agrees to sell, a permanent utilities and access Easement over Seller's property <br />known as WHITE OAK DRIVE, and legally described, as TRACT I, Registered Land <br />Survey No. 1447, situated in the County of HENNEPIN, State of MINNESOTA. <br />The Easement shall include an easement for all utilities, including gas, electric, <br />water, cable television or other such communication cable systems, sewage and <br />drainage, and driveway and access easement for no more than three separate parcels <br />on the adjoining property now owned by the Buyers. <br />Buyers and Sellers agree that the price for the Easement shall be: <br />$2,000.00 for each parcel of land, if three parcels are developed; or <br />$3,000.00 for each parcel of land, if two parcels are developed. <br />The remaining amount to be due and owing on the purchase price of <br />the easement shall be paid at time of sale of any such parcel or no later <br />than August 15, 1986. In the event that the property is unable to be <br />subdivided as anticipated, and Buyers do not otherwise exercise their rights <br />to purchase said easement, this agreement shall be null and void on or after <br />August 15, 1986. <br />The Buyers agree that upon full payment for the Easement, the Buyers, or their <br />assigns, shall assume their pro rate share in the cost of maintenance and improvement <br />of WHITE OAK. DRIVE. <br />It is also understood and agreed by the parties that a portion of the purchase <br />price of said Easement shall be use for maintenance or improvement of WHITE OAK <br />DRIVE at or about the time purchase is completed. <br />This Easement shall run with the land and shall be binding un and shall enure to <br />the benefit of the parties hereto, their heirs, successors or assigns. <br />The parties hereto, in acknowledgement and acceptance of the above agreement <br />and the sale made thereby and the conditions expressed therein, hereby execute this <br />dogument.
