City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A VARIANCE AND CONDITIONAL USE PERMIT <br />TO MUNICIPAL ZONING CODE SECTION 10.20, SUBDIVISION 3 (G ) - FILE 1856 <br />WHEREAS, Edward L. Beck (hereinafter "the applicant") is <br />owner of the property located at 1280 North Arm Drive within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lots 7, 8, and 9, Block 3, Saga Hill Revised (hereafter <br />"property"), and <br />WHEREAS, the applicant has made application to the City of <br />Orono to permit the creation of a temporary guest apartment within the <br />walkout level of the Existing house at 1280 North Arm Drive by <br />constructing separate kitchen facilities. <br />NOW, TH2REFORE BE IT RESOLVED by the City Counci 1 of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file #856. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore Residential Zoning District. <br />3. The property is approximately 0.75 acre in area. <br />4. The Orono Planning Commission reviewed thisapplicatio,l <br />on September 17, 1984, and recommended approval of the <br />proposed variance to t6he 2 acre lot area requirement for the <br />temporary second dwelling i-it. per Zoning Code Section <br />10.08, Subdivision 3(A)(7), and recommended approval of a <br />conditional use permit for the temporary guest apartment, <br />subject to the following conditions: <br />a) The guest apartment is for use of family members <br />only. <br />b) This guest apartment use may nut be conveyed to a <br />purchaser of the property. <br />c) The guest apartment may not be rented out. <br />d) This use is subject to City review at the end of <br />four years. <br />
