CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 (B), 2 AND <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO. 2038 <br />WHEREAS, Richard J. Heit (herei-iafter "the applicant") is the owner of the <br />property located at 1153 Elmwood Avenue within the City of Orono and legally described as <br />follows: <br />Lots 8 and 19, Skarp and Lindquist's Fernhill, Lake Minnetonka, according to <br />the recorded plat thereof, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section 10.22, Subdivisions 1 (B) and 2 and Section 10.24, Subdivision 5 (B) to <br />permit construction of a 10' x 28.3' two-story addition to the lakeside of the residence to be <br />located 9' 4" from the north side lot line where a 10' setback is required. Construction will <br />result in 56 s.f. of new hardcover with total hardcover proposed at 4,120 s.f. or 51% where <br />25% is allowed and where 4,213 s.f. or 52 o exists; and an average lakeshore setback variance <br />of 32' where no such encroachment is allowed and where a 30' encroachment exists. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was re :dewed as Zoning File #2038. <br />2. Ti:e property is located in the LR-113 Lakeshore Residential Zoning District <br />requiring one acre in area. <br />3. The Orono Plattning Commission reviewed this application on July 17, 1995 and <br />recommended approval of the variances as proposed based upon the following <br />unique findings and hardships: <br />Page 1 of 6 <br />
