ROBERT MERRILL ROSENBERG <br />PAOF'ESSIONAL ASSOCIATION <br />LAWYER <br />October 1, 1993 <br />Page 2 <br />In early 1992, Mr. and Mrs. Brent Johnson, who were buying the <br />existing house on the property obtained a mortgage commitment. <br />This necessitated Mr. and Mrs. Mark Johnson conveying the fee <br />interest in the property (which had been subject to a contract <br />for deed) so that financing could be placed on the residence. <br />The finance transaction also necessitated an amendment to the <br />Torrens application to reflect the changes in ownership and <br />lenders. <br />These necessary changes to the Torrens application were made and <br />the proceeding resumed, with a final directive being issued on <br />September 14, 1992 (a few days after the resolution expired). <br />Because of the changes that had taken place in the status of <br />title, the original mylars were no longer accurate, and it took <br />an additional 8 months after the conclusion of the Torrens matter <br />for the surveyor to complete the necessary changes in the plat <br />dedication as to ownership and secured parties. · <br />The revised mylars were finally completed and the fee owner's <br />signature obtained in April of 1993. The new lender's home <br />office is in Milwaukee, and Mr. Johnson was at a disadvantage in <br />obtaining the lender's signature as no one in the lender's local <br />office was available to sign the plat on behalf of the bank. <br />Faced with this difficulty, Mr. Johnson again contacted my <br />office, and I located the parties authorized to sign the plat <br />through the Bank's corporate counsel in Milwaukee, and made <br />arrangements for the Plat to be delivered to Milwaukee and <br />returned. <br />Following signature by the lender, the plat was also signed by <br />the surveyor, and is now ready for submission to the council, <br />however we are clearly beyond the period for the preliminary <br />approval resolution. <br />It is my understanding that the Johnsons timely paid the $300 <br />Final Plat and Legal Review Fee, and have paid in full the <br />$2,544.00 Park Dedication Fee. The requirements of the <br />preliminary plat approval have been complied with, and the <br />applicants are ready to submit any further final documentation, <br />if any, that may be required. ·
