Maybusth <br />Building and Zoning Administrator _ <br />Re: Plat at 4465 Bayside Road <br />Resolution No. 3014. <br />Dear Ms. Maybusth, <br />SUITE 2500 <br />ONE FINANCIAL PLAZA <br />120 SOUTH SIXTH STREET <br />MINNEAPOLIS, MINNESOTA 55402 <br />FACSIMILE 349-9962 <br />TELEPHONE 349-5290 <br />AAEACODE612 <br />Thank you again for your courtesy in our recent phone <br />conversation concerning my request that the Council extend the <br />expiration date of this Resolution to permit the presentation of <br />the final plat of two residential lots (one already developed) <br />and an outlet. <br />I represent Mr. and Mrs. Mark Johnson, who are in the process of <br />splitting a 4.41 acre parcel at 4465 Bayside Road into two lots. <br />Through circumstances not fully within the Johnson's control, and <br />the presentation of the final mylars of the plat for approval has <br />taken longer than initially anticipated. <br />The application to split the property was made in the summer of <br />1991 and a public hearing held before the planning commission in <br />July of that year. The proposal was approved, and presented to <br />the Council which gave preliminary approval to the plat at its <br />meeting of September 9, 1991. That preliminary approval was to <br />expire one year later. <br />Concurrent with the plat approval process, a decision had been <br />made to Torrens the property under the new "Certificate of <br />Possessory Title" procedure prior to the actual filing of the <br />plat. That proceeding was filed on November 29, 1991, and as .the <br />new proceeding does not require a district court judgment, it was <br />anticipated that it would be completed within a few months. <br />REAL PROPERTY LAW SPECIALIST <br />CERTIFIED BY THE MINNESOTA STAT.E BAR ASSOCIATION
