ORONO CITY COUNCIL MEETING <br />MINUTES FOR SEPTEMBER 28, 1998 <br />(#2368 Kirk Otteson, continued) <br />foet to comply with the average lakeshore setback. <br />Mayor Jabbour stated the City Council usually does not get involved in structural issues but defers <br />those matters to the building inspector. <br />Otteson stated he had a structural engineer review the foundation of the house and he has stated <br />the present foundation is okay to build on, after underpinning along one wall. <br />l\fayor fabbour suggested Mr. Otteson contact the building inspector and work that matter out between <br />the two of them. <br />Moorse stated the building inspector preferred that a new foundation be built. <br />Mayor Jabbour stated the issue before the City Council tonight is if we had understood that this house <br />would be torn dO\vn to the foundation would we still have approved these variances. <br />Otteson stated the intent of the project remains the same in his view and he is merely trying to <br />meet current standard construction practices. Otteson stated they felt they were in a gray <br />area as to what they were allov,ed to do under the application. Otteson remarked the building <br />inspector has stated the joists are not adequate to build on and need to be replaced which was not <br />kno\\TI until some sheetrock was removed from the wall. <br />Kelley commented it is usually hard to predict what will need to be replaced until the project is <br />underway, noting he is in favor of the project going forward. Kelley stated if the foundation needs to <br />be replaced based upon the opinion of the building inspector, then the application should be reviewed. <br />Goetten stated the safety of the occupants needs to be taken into consideration. <br />Mayor Jabbour commented minor repair of the foundation is okay. <br />Van Zomeren stated the Applicants are planning to have the foundation certified and are attempting <br />to comply with the City's requirements. <br />Goetten moved, Peterson seconded, to approve #2368, 710 North Arm Drive, allowing <br />construction to continue as originally approved subject to certification by a structural <br />engineer that the foundation can be built upon. VOTE: Ayes 5, Nays 0. <br />(#5) #2401 THOMASAND MARGARET RADKE, 3424 EASTLAKE STREET- <br />VARIANCE/RESOLUTION NO. 4163 <br />Thomas and Margaret Radke were present. <br />Kelley stated he is not opposed to the application, but has concerns about the other property owner <br />wanting to build a shed on the property in the future. Kelley stated the neighbor should be allowed to <br />construct a similar shed on the property if he so desires. <br />Page 7
