' <br />Ai RESOLUTION APPROVING <br />A IvIETES ~ND BOUNDS CLASS I SlJBDIVISION <br />OF PROPERTY LOCATED AT 4355 BAYSIDE ROAD <br />FILE NO. 2412 <br />WHEREAS, th~ City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has <br />adopted subdivision regulations for the orderly, economic and safe development of land vvithin the <br />City; and <br />\VHEREAS, th~ City Council has considered the application for a 2-lot Class I metes <br />and bounds subdivision by Ste!l/e White and VCI Capital, Inc. (hereinafter "the subdividers") of <br />property located at 4355 BaysiM Road and legally described in the sunrey attached hereto as Exhibit <br />A (hereinafter "the property"); ~nd <br />\VHEREAS, th~ subdividers have completed all requirements of the City for a 2-lot <br />metes and bounds Class I subdiivision of the property. <br />NOW, THERE4FORE, BE IT RESOLVED, that the City Council of the City of <br />Orono hereby approves the 2-lo1 metes and bounds Clac;s I subdivision for the subdividers as shov,m <br />on the Ce11ificate of Survey by Mark S. Gronberg, a licensed s1m·eyor of Coffin and Gronberg, Inc., <br />dated August 19, 1997, revised October 6, 1997 and attached to this resolution a5 Exhibit A, subject <br />to the following conditions: <br />1. The subdividers shall grant Conservation and Flowagc Easements to the City over <br />the wetlands shi)wn on the attached survey. The subdividers shall provide legal <br />descriptions for said easements. <br />2. The subdividers shall grant to Hennepin County a 66' road, drainage and utility <br />easement over th)e portions of County Road 84 (Bayside Road) shovm on the attached <br />survey. 1be subdividers shall provide a legal description for said easements. <br />3.
