Revenue ENTITLEMENT PERIOD 16 O <br />ShariNj OCTOBER 1, 1984 - SEPTEMBER 30, 1985 16 <br />Statement of Assurances <br />The sciplent government assures that It will: <br />(1) Establish a trust fund and deposit all Revenue Sharing funds received in that trust fund, <br />according to regulations prescribed by the Office of Revenue Sharing. <br />(2) Spend, appropriate, or obligate Revenue Sharing funds within a reasonable time (two <br />years from the end of each entitlement period) according to regulations prescribed by the <br />Office of Revenue Sharing. <br />(3) Not use entitlement funds for lobbying or other activities Intended to Influence any <br />legislation regarding the provisions of the Revenue Sharing Act. <br />(4) Provide for the expenditure of Revenue Sharing funds in accordance with State and <br />local laws and procedures applicable to the expenditure of its own revenues. <br />(5) Use fiscal, accounting, and audit procedures, as specified by the Office of Revenue <br />Sharing; provide access to and the right to examine books, documents, papers, or records for <br />purposes of reviewing compliance with the Revenue Sharing Act; and submit such reports as <br />the Director may require. <br />(6) Comply with the independent audit requirements under the Revenue Sharing Act and <br />Regulations. <br />(7) Comply with the public hearing and the public participation requirements of the <br />Revenue Sharing Act and Regulations. <br />(8) Comply with the prevailing wage provisions of the Davis -Bacon Act on any construction <br />project costing In excess of $2,000 when 25 percent or more of the costs of such projects is <br />paid with Revenue Sharing funds. <br />(9) Pay individuals employed in lobs financed in whole or in part with Revenue Sharing <br />f unds not less than the prevailing rates of pay for persons employed In similar public occupa. <br />tions by the same employer. This provision does not apply to an employee or employees in any <br />program category who are being paid In whole or in part with Revenue Sharing funds unless 25 <br />percent or more of the total wages paid to all employees in that category are paid from Revenue <br />Sharing funds. <br />(10) Not exclude from participation in, deny the benefits of, or subject to discrimination <br />under any program or activity, any person In the United Slates on the grounds of race, color, na- <br />tional origin, or sex. Not discriminate on the basis of age under the Age Discrimination Act of <br />1975, of with respect to an otherwise qualified handicapped Inch idual as provided In Section <br />504 of the Rshabilitation Act of 11 or on the basis of religion, except that any exemption from <br />such prohibition against discrimination on the basis of religion ■a provided in the Civil Rights <br />Act of 19114, or Title VII of the Act of April 11. 1968. shall also appe ,his assurance includes <br />compliance with the administrative requirements of the Revenue Sharing final handicapped <br />discrimination provisions contained in Section 51.55 (c), (d), (0), and (k) (5) of the Regulations. <br />(11) ^rovide within 10 days of receipt by the recipient government a copy of a holding (as <br />defined n the Revenue Sharing Regulations) to the Director of the Office of Revenue Sharing, in <br />the event a Federal or State court or Federal administrative law judge makes such a holding <br />&gains• the recipient. <br />I assure the Director of the Office of Revenue Sharing that this government will comply <br />with the requirements of the Revenue Sharing Act (31 U.S.C. 67016724) and the Regulations (31 <br />C.F.R. pan 51), with respect to payments received under the Act. <br />I understand that the acceptance of the Statement of Assurances Certification Form for <br />Entitlemem Period 16 by the Director of the Office of Revenue Sharing, does not prevent the <br />Director from holding a recipient government responsible for noncompliance with the Revenue <br />Sharing Act and the Regulations <br />ORS GS AUG nea <br />
