MINUTES OF THE REGULAR COUNCIL MEETING HELD ON AUGUST 27, 1984. PAGE, 8 <br />NORTH SHORE DRIVE MARINA <br />1984 COMMERCIAL DOCK LIC <br />RESOLUTION #1664 Larry Hork was present. Herman Renner of 3180 North <br />Shore Drive was also present. <br />Zoning Administrator Mabusth noted for the record that <br />North Shore Drive Marina was dredging without a permit <br />from the City. Mabusth stated that she contacted the <br />DNR and that they had no record of a permit either. <br />Mabusth suggested tabling the 1984 commercial dock <br />license until North Shore Drive Marina applies for a <br />dredging permit.. <br />Larry Hork presented a DNR permit from 1969 and 1977 <br />and stated that the DNR permit had a maintenance <br />dredging provision. Hork stated that there was <br />miscommunication on the DNi:'s part in that they <br />couldn't fi-• a record of this permit. Hork stated <br />that they i ? the permit and everything is ok with <br />the DNR. Hork stated that he talked to the MCWD and <br />they needed to see where the fill was going. Hork <br />stated that he didn't think he needed a permit for the <br />wor.l done since it was maintenance dredging. Hork <br />stated that the fill was going to be used for the <br />building of the garage. <br />City Attorney Malkerson stated that there is a valid <br />DNR permit. Malkerson stated that the City does have <br />an ordinance which requires a permit for dredging and <br />that Hork should apply for such permit. Malkerson <br />stated that he is surprised that the MCWD doesn't <br />require permit. Malkerson stated that Council must <br />decide whether Fork should continue the dredging or <br />not. Malkerson stated that the 1984 commercial dock <br />license application should be treated as a separate <br />issue and need not be tied into the dredging issue. <br />Zoning Administrator Mabusth advised Hork that this <br />DNR permit was not valid with the City and that the City <br />requires a separate conditional use permit. <br />Larry Hork stated that only about 10' of dredging is <br />lef t to do and that he is not dredging out into the lake. <br />Hork stated that. he needs the dock license for his <br />f inancial agency. Hork noted that neither the DNR or <br />the MCWD told him that he needed a permit with the City. <br />Hork stated that the dredging is in between the two <br />docks only. <br />Herman Renner stated that <br />bigger boats every year he <br />to keep dredging. Renner - <br />houseboat is still parked <br />there all summer.
