Tom Rutten, the attorney for Mr. Smith, and <br />I have been exchanging phone calls for several weeks on this <br />matter. I spoke to him today and he said that he has been out oc <br />town all of November and half of December on a major litigation <br />case in New York. He stated that he has spoken on three occasions <br />with the Powers but he has not been able to work out any details <br />with them concerning the acquisition of the sewer easement. The <br />Powers have stated to him that they need more time to review the <br />appraisal previously submitted by the City. He has informed them <br />that the City has asked that they resolve this matter immediately <br />so the City need not become further involved and the Powers have <br />told him to tell the City that they want more time. He has been <br />given authority from his client to negotiate the easement on <br />behalf of Mr. Smith. Mr. Smith would like to use Plan C providing <br />for the construction of the sewer under the existing easement. <br />Apparently the Powers may want to use Plan B which provides for <br />the construction of the sewer in a different location. However, <br />the Powers have not said that they are willing to agree to any <br />purchase agreement regardless of the plan that may be used. <br />�- I <br />
