Owner. In case written consent is given, the Contractor will be permitted to <br />sublet a portion of the contract or corporate stock thereof, but shall per- <br />form, with his own organization, Work amounting to not less than 50 percent of <br />the total original contract cost. No subcontra t s or transfer of contract or <br />corporate stock shall release the Contractor of his liability under the Con- <br />tract or Bonds. <br />5.3 RIGHTS OF VARIOUS INTERESTS <br />rr <br />Wherever Work being done by the Owner's forces or by other Contractors is <br />contiguous to Work covered by this Contract, the respective rights of the <br />various interests involved shall be established by agreement to secure the .� <br />completion of the various portions, of the Work in general harmony. <br />5.4 SEPARATE CONTRACTS <br />+w <br />The Owner may let other contracts in connection with the Work of the <br />Contractor. The Contractor shall cooperate with other Contractors with regard <br />to storage of materials and execution of thei• Work. It shall be the <br />Contractor's responsibility to inspect all work by other Contractors affecting <br />his Work and to report to the Engineer any irregularities which will not <br />permit him to complete his work in a satisfactory manner. His failure to <br />notify the Engineer of such irregularities shall indicate the work of other <br />Contractors has been satisfactorily completed to receive his Work. The <br />Contractor shall not be responsible for defects of which he could not have <br />known, which develop in the Work of others Rfter the Work is completed. It <br />shall be the responsibility of the Contractor to measure the completed work in <br />place and report to the Engineer immediately any difference between completed <br />work by others and the Drawings. <br />5.5 SUBCONTRACTS <br />Nothing herein shall create any legal relationship between the Owner or <br />Engineer and any subcontractor, and no subcontractor shall have any rights <br />under this Contractor's agreement with the Own-r. The Contractor's award of <br />subcontracts shall be subject to the following: <br />5.5.1 Unless otherwise specified in the Contract Documents, the Con- <br />tractor shall, upon receipt of the executed Contract Documents, submit in <br />writing to the Owner the names of the Subcontractor proposed for the Work. <br />Subcontractors may not be changed except at the request or with the con- <br />sent of the Owner. Contractor shall not employ any Subcontractor or other <br />person or organization (including those who are to furnish the principal <br />items of materials or equipment), whether initially or as a substitute <br />ow <br />against whom Owner or Engineer may have reasonable objection. A Sub- <br />contractor or other person or organization identified in writing to Owner <br />R <br />and Engineer by Contractor prior to the Notice of Award and not objected <br />to in writing by Owner or Engineer prior to the Notice of Award will be <br />fto <br />deemed acceptable to Owner and Engineer. Acceptance of any Subcontractor, <br />other person or organization by Owner or Engineer shall not constitute a <br />waiver of any right of Owner or Engineer to reject defective Work.
