A <br />4.2 ORDER OF PRECEDENCE <br />If there be a conflict between or among any of the terms or provisions of the <br />Contract Documents, which conflict cannot be reconcile,-- '-y resorting to the •.•, <br />intent of this Contract under Paragraph 4.i, the conflict shall be resolved by <br />applying the following Order of Precedence: <br />(a) Agreement; so <br />(b) Conditions of the Contract; <br />(c) Special Provisions; <br />(d) Specifications - Specific Requirements; <br />4, <br />(e) Specifications - General Requirements <br />(f) Prawings. <br />4.3 DISCREPA"C1ES <br />Any ambiguity or discrepancy in the Drawings and Specifications, no matter how <br />seemingly insignificant to the Contractor, shall be brought immediately to the <br />attention of the Engineer for clarification. Any Contractor who fails to <br />bring any ambiguity or discrepancy of which it was or should have been aware, <br />shall assume the risk of loss of claim, and shall be aLlowed no claim, for the <br />misinterpretation of the Drawings and Specifications contrary to the intended <br />interpretation of the Engineer. <br />4.4 ADDITIONAL INSTRUCTIONS <br />Further or additional instructions may be issued by the Engineer during the <br />am <br />progress of the Work by the use of Drawi-- or other means 'o clarify the <br />0 <br />Contract Documents or to explain or illustt ;e changes in the Work to be done.04 <br />4 <br />4.5 COPIES OF DRAWINGS AND SPECIFICATIONS FURNISHED <br />— <br />f <br />� <br />Mr <br />Except as provided for otherwise, five (5) copies of Drawings and <br />Specifications shall be furnished to the Contractor without charge. <br />4.6 DRAWINGS AND SPECIFICATIONS AT JOB SITE <br />t, <br />One complete set of all Drawings and Specifications, Addenda, approved Shop <br />Drawings, Change Orders and Other Modifications shall be maintained by the <br />Contractur at the job site anti shall be available to the Engineer at all times. <br />4.7 OWNERSHIP OF DRAWINGS AND SPECIFICATION <br />.� <br />All Drawings and Specifications and copies thereof and other data furnished by <br />the Engineer are and shall remain his property. They are to be used only with <br />respect to this Project and are not to be used on any other project.
