City of ORONO <br />RESOL U T I O N OF T H E C I TY CO UN_Cl,t;-,..,-'1 <br />~.,<P ·_l -·, .. <br />NO. 2903 : · . · ·· <br />~ _, -· <br />WHEREAS, the two newly created building lots and the <br />two existing homestead lots all have been demonstrated to contain <br />suitable sites for primary and alternate drainfields to serve the <br />existing or proposed single family residences; and <br />WHEREAS, except for the variances noted above, the <br />subdivision has been found to meet all other standards of the LR- <br />lA zoning district, finding that each lot is of a size and ' <br />configuration that will allow its use as a single family <br />residence to be fully developed without the need of further <br />variances; and <br />WHEREAS, the subdivider has completed all requirements <br />of the platting regulations of the City, including: <br />1. Completion of all the requirements of Resolution 12762. <br />2. Creation of a private driveway outlot shown on the plat <br />as Outlot A. <br />3. Applicant has obtained the necessary private driveway <br />access easement across the adjacent White property, in order <br />to gain access to Bayside Road for Lots 2 and 3. <br />4. Payment to the City of a Park Dedication Fee of $2 oq.oo <br />each for Lots 2 and 3 totaling $400.00. <br />5. Payment to the City of final plat administrative fee of <br />$150.00 and legal review and filing fees of $75.00. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Orono hereby approves the plat of Bayside Ridge, <br />Hennepin County, Minnesota, subject to the following condition: <br />1. A variance is hereby granted for Lot 2 to the 200' lot <br />width standard and for lack of frontage on a public roadway. <br />2. Access to Lots 2 and 3 shall be via the private driveway <br />easement across the White property to the north. At such <br />future time that an alternative access becomes legally <br />available to Lots 2 and 3 via the existing private road near <br />the westerly boundary of Lot 3 and Outlot A, Lots 2 and 3 <br />shall be required to access to such private road and all <br />direct access or easement driveway access to Bayside Road <br />shall at that time be eliminated. <br />3. Lots 1 and 4 will continue to use and maintain their <br />private driveway accesses as currently exist. <br />Page 2 of 3
