City of ORONO <br />RESOLUT I O N OF T H E C ITY CO U NC I L <br />N O. 2903 <br />A RESOLUTION APPROVING THE PLAT OF <br />BAYSIDE RIDGE <br />FILE NO. 1475 <br />WHEREASr the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREASr the City Council of the City of Orono has <br />adopted subdivision regulations for the orderly, economic and <br />safe developm~nt of land within the City; and <br />WHEREASr the City . Counci 1 has considered the <br />application for a subdivision by John McDowell and Charles N. <br />Hayssen, the subdividers; and <br />WHEREASr on February 26, 1990, the City Council <br />approved Resolution #2762 granting preliminary approval for a <br />plat at 4045-4135 Bayside Road; and <br />WHEREASr the proposed plat contains four lots, each <br />exceeding the 2.0 acre minimum lot area requirement. Lots 1 and <br />4 contain existing residences, and are included in the plat to <br />accommodate rearrangement of lot lines. Lots 2 and 3 are created <br />as two new building sites. Lot 3 requires a variance by virtue <br />of it being a newly created lot without frontage on a public <br />roadway. Lot 3 requires a variance to the 200' lot width <br />standard; and <br />WHEREASr proposed Lots 2 and 3 are intended to access <br />to Bayside Road via an easement shared driveway over the <br />neighboring abutting property between Lots 2 and 3 and Bayside <br />Road. This shared driveway shall be constructed as a private <br />driveway and will not be subject to a City Road and Utility <br />Easement; and <br />WHEREASr a 25' wide driveway outlot platted as Outlot A · <br />is intended to remain in the same ownership as Lot 2 and is <br />intended to provide legal access to the westerly existing private <br />easement road should access for Lot 2 become available to that <br />roadway in the future. It is further intended that until such <br />time that Lots 2 and 3 gain legal access to Bayside Road via the <br />existing private road across the neighboring White property, at <br />that time Lots 2 and 3 shall be required to access to such <br />private road and all direct access or easement driveway access to <br />Bayside Road at that time shall be eliminated; and <br />Page 1 of 3 <br />Ii <br />~
