MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />MONDAY, MAY 17, 2004 <br />6:00 o'clock p.m. <br />(15. #04-3017 SPRUCE HILL PROPERTIES, INC., Continued) <br />Chair Mabusth pointed out the existing patio/landing is cracked and suggested it be replaced. The applicants <br />indicated it is proposed to be replaced. <br />Chair Mabusth moved, Kempf seconded, to recommend approval of Application #04-3017, Spruce Hill <br />Properties, to grant a hardcover variance to permit less than 3.8% hardcover within the 0-75' zone <br />when 0% is normally allowed and 3.9% currently exists (removal of7.5' x 2.5' chimney shaft) and when <br />added to the 75'-250' zone allowance yields total hardcover of less than 30% due to the reduction in size <br />of the patio by about 6', to grant a lake setback variance to permit structure within 75' of the lake and <br />to grant a street yard setback variance to permit a 22' setback when 50' is normally required and 22' <br />currently exists. She commented that this is certainly a hardship lot. <br />Chair Mabusth asked for public comment. There were none. <br />VOTE: Ayes 7, Nays 0. <br />Curtis advised the applicant to mark up the proposed patio removals on the application and provide the square <br />footage measurements and return them to the City for inclusion in the approving resolution and site plan, and <br />that a new survey is not required. <br />16. #04-3021 CITY OF ORONO, ZONING CODE REVISIONS SECTIONS 78-72, 78-281, 78-282, <br />78-283-78-1279(6), 78-1405, 78-1432, ALLOW ADMINISTRATIVE APPROVALS AND REMOVE <br />DUPLICATE LANGUAGE, PUBLIC HEARING (11:51-11:54 p.m.) <br />Chair Mabusth moved, Leslie seconded, to recommend approval of the Zoning Ordinance Amendments <br />for Sections 78-1405 Entrance Monuments, 78-72 Administrative Approval, 78-282-300 Deletes <br />Duplicate Language, 78-1279 (6) Administrative Approval and 78-14342 Accessory Buildings. <br />Chair Mabusth asked for public comments. There were none. <br />VOTE: Ayes 7, Nays 0. <br />PLANNING COMMISSION COMMENTS <br />17. REPORT OF PLANNING COMMISSION REPRESENTATIVES ATTENDING CITY COUNCIL <br />MEETINGS APRIL 25, 2004 AND MAY 10, 2004. <br />Kempf reported on the May 10, 2004 City Council meeting he attended. Gaffron added that Big Island access <br />application was approved and the MCWD is requiring filing of an easement declaration that is yet to be <br />detennined. <br />Leslie reported on the April 26, 2004 City Council meeting, noting that the Valerius coffee house application <br />discussion emphasized the need for proof of hardship that was echoed by the Planning Commission discussion <br />and recommendation. As a new Planning Commission member, he thought this was confirming to what the <br />Planning Commission's goals are for granting hardship variances. <br />He explained the City Council action took out the parking spaces on the Valerius application. <br />Page 39 of 40
