Desire of applicant to balance visual needs of property owner to the north and <br />preserve lake views where neighbor has no legal claim as property is not a <br />lakeshore lot. <br />5. Agreement with neighbors to west to maintain 15' setback from west lot line. <br />The minority opinion felt the house was too ambitious and there should have been an attempt to <br />reduce the setbacks further. The member noted it was not necessary to grant a variance to the 50' <br />setback from Bayside Road for the roofed deck that could have been relocated out of the 50' <br />setback area. <br />Planning Commission Recommendation <br />The Planning Commission recommended approval of the application as proposed subject to the <br />ollowing conditions: <br />1. Applicant to provide a revised survey locating all approved hardcover <br />improvements on survey and to provide an updated hardcover inventory upon <br />application for a building permit. <br />2. Prior to filing a building permit application, applicant must apply for the legal <br />combination of Lots 1, 2, 3, and 4, Otterville on Lake Minnetonka Minnesota with <br />the vacated alley. <br />COUNCIL ACTION REQUESTED: <br />To either amend or approve the closed approval resolution. <br />ch
