page 2 <br />#589 James McCleary, 3445 Bayside Road - Preliminary Subdivision <br />the contractor who buys the property and constructs the houses <br />to supply the testing information for the on -site mound system. <br />Council should note Gaffron's last comment in his memo of 1-21-81. <br />If the applicant refuses to submit the necessary testing, septic <br />design and "legal document" defining ownership, maintenance, <br />repairs etc. then a total holding tank system may be required to <br />serve the 3 proposed residences. The percolation tests are required <br />to determine if there is suitable and sufficient land available <br />to support an on -site mound system. If test information is not <br />available, Council's preliminary approval may be conditioned on <br />a total holding tank system. <br />The following recommendation merely setsforth options available <br />to Council for their consideration. The amending of the original <br />Planning Com.,, ssion recommendation results from applicant advising <br />staff of his position after the January 19th meeting. <br />To recommend preliminary approval of the Bayside Beach Plat <br />reaffirming the variances granted to the LR-lA zoning district <br />setforth in the rezoning agreement for Stubbs Bay Marina based <br />on the follnwin- findings: <br />1. All marina use has been discontinued. <br />2. Standards setforth for preliminary plat approval have <br />been met. <br />And subject to the following -ondit:ions: <br />1. Options for treatment of wastes both black and gray waters. <br />a. A total holding tank system to serve the three residental <br />lots <br />b. Provided necessary test information received before <br />final plat apprc,va- <br />1. Black water for each residential unit contained <br />in holding tank, on homestead lots <br />2. 3 residences qray water treated by a single on -site <br />mound disposal system located on Outlot B. <br />2. Options on access <br />a. Design separate road Outlot within Outlot B as requested <br />by the Plannina Commission. <br />b. Allow Outlot B to remain as designated for access and <br />treatment area for gray wester. <br />
