Page 2 <br />4) The creation of a shared commons area shown on <br />the plat as Outlot B, said outlot will contain <br />the follOW4 ng improvements: <br />a) A separate sand/mound berm for the treat- <br />ment of each of the three residences' <br />graywater; toilet wastes from each of the <br />residences shall be collected in holding <br />tanks located on individual lots 1, 2 and <br />3, Block 1. <br />b) A private driveway will be constructed to <br />serve all three residences; a single, new <br />curb cut will be created on Eastlake Street. <br />5) Concurrent with the creation of this shared <br />rnmmons area, the subdivider has created a non <br />exzlusive private sewage treatment system ease- <br />ment over and across Outlot B for the mutual <br />benefit of Lots 1, 2 and 3, Block 1 including <br />a declaration of certain maintenance covenants <br />wherein each of the benefiting lot owners covenants <br />a.­d agrees to permanently maintain and pay the cost <br />or maintenance for said private sewage treatment <br />system. <br />6) Payment to the City for legal review and filing <br />fees of $50.00. <br />NOW, THEREFORE BE IT RESOLVED that the City Council of the <br />Cit of Orono hereby approves the plat of BAYSIDE BEACH, Hennepin <br />County, Minnesota; subject to the following conditions: <br />1) The well/hand pump located on the above described <br />property must be filled and sealed prior to the <br />issuance of the first building permit. <br />2) The existing access to County Road 84 must be <br />removed and ground cover restored at the time <br />of the construction of the shared driveway located <br />in Outlot B. <br />3) If at any time in the future, any one of the <br />individual sewage disposal systems on Outlot B <br />fails to meet the required standards of the <br />Orono on site septic code, the City will require <br />the immediate replacement and installation of an <br />appropriate sized holding tank. <br />
