A RESOLu'PION APPROVING THE PLAT OF <br />BAYSIDE BEACH <br />WHEREAS, the City of OrorLk, :_ a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development <br />of land within the City; and <br />WHEREAS, the City Council has considered the application for <br />a subdivision plat by JE_n�s McCleary hereinafter referred to as the <br />subdivider; and <br />WHEREAS, on Jun~ 1980, the City of Orono together with <br />the subdivider entered into an agreement in which one of the agreed <br />upon conditions granted the following variances to the standards of <br />the LR-lA zoning district, such variances are valid through June 27, <br />1990: <br />1) Lot Area: The LR-lA zoning district requires 2 <br />acres or 87,120 sf of area; the subdivider was <br />granted an average minimum lot size of S acre or <br />or 21,780 sf. <br />2) Lot Width: The 1,21-1A zoning district requires a <br />minimum of 200 feet of width; the subdivider was <br />granted a minimum lot width of 75 feet. <br />3) Street Setback: The LR-lA zoning district requires <br />a 50 foot setback for all structures; the subdivider <br />was granted a 20 foot street setback. <br />4) Sideyard Setback: The LR-lA zoning district requires <br />a 30 foot setback for all principal structures; the <br />subdivider was granted a 10 foot sideyard setback; and <br />WHEREAS, the subdivider has completed all requirements of the <br />platting regulations of the City, including: <br />1) Dedication on the plat of drainage and utility <br />easements. <br />2) Dedication on the plat of right of way for a <br />public road shown as County Read No. 84. <br />3) Dedication to the City of an open space easement <br />over Outlot A, a substandard lot located in the <br />LR-lA zoning district to be combined with a <br />buildable parcel of land within 2,000 feet, said <br />easement limits the use of the riparian outlot to <br />she construction of one single family residential <br />deck only if a residence exists on the buildable <br />lot described above. <br />
