Side Yard Variance <br />Required: <br />30' <br />Proposed: <br />10.8' <br />Variance: <br />19.2' (66%) <br />The Huber variance application has been subject to the same reviewing <br />process as the two previous variance applications to the moratorium - <br />#501 (Gerald Gustafson) setback variance for basement addition and <br />0503 (Henry Schmitz) setback variance for detached garage. The <br />Hubers propose an addition with two bedrooms and a bathroom requiring <br />a side yard setback. This reviewing process involves Michael saffron, <br />the septic system inspector, inspecting each site plan to assure that <br />adequate area remains for septic expansion, either additional area to <br />expand existing system and/or adequate area for an alternate system. <br />The intent of the septic code is to preserve on both new and existing <br />lots enough area to handle all future sewage treatment needs in the <br />unsewered area. Michael Gaffron has detailed this application of the <br />septic code in his memo dated September 19, 1979 (Exhibit 0). <br />The Hubert did not have enough area tr satisfy both the addition and <br />the septic code's demands. Our advice was to acquire additional land <br />from the neighboring property owner. Gaffron'■ memo of September 24, 1979 <br />(Exhibit 71 reviews the effects of this acquisition on both the Huber's <br />application and the neiqhor's property. <br />Approval of the Huber's variance application was based on the following <br />conditions: <br />1. Applicant submit proof of legal lot combination before <br />building permit can be issued. <br />2. The acquisition of additional land for an alternate drainfield <br />area r..eets the intent of the septic code in providing self- <br />sufficient septic treatment and therefore the intent of the <br />moratorium is not violated. These conclusions are based on the <br />septic inspe--tor's findings and recommendations. <br />
