MINUTES OF THE PLANNING COMMISSION MEETING FEBRUARY 21, 1989 <br />ZONING FILE #1371-MINKEMA CONTINUED <br />and the public hearing was closed. <br />It was moved by Planning Commissioner Brown, seconded by <br />Planning Commissioner Cohen, to recommend approval of application <br />#1371, both front and side yard setback variances. The hardship <br />is the location of the existing residence and that there is no <br />additional encroachment. Motion, Ayes=6, Nays=0, Motion passed. <br />#1373 DAVE HISS <br />1635 CONCORDIA STREET <br />CONDITIONAL USE PERMIT <br />PUBLIC HHARING 7:51 P.M. - 7:57 P.M. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />The applicant was present for this matter. <br />Zoning Administrator Mabusth informed the Planning <br />Commission that Mr. Eiss was seeking a conditional use permit and <br />variance for land alterations in the 0-75' setback area. Mr. <br />Eiss's new residence is located within a pre-existing retention <br />area which serves the 1.44 acre watershed. Mr. Bozonie, a <br />neiqhbor to the south of Mr. Eiss, communicated to the City his <br />understanding of the drainage pattern for the area. Public Works <br />Director Gerhardson has recommended the use of the drainage swale <br />or underground tile because a private drainage system to the <br />south would have a significant impact upon the Trainor property. <br />Gerhardson has confirmed that the existing drainage ditch within <br />the Trainor property is not a public drainage way. <br />Chairman Kelley questioned the number of trees that would <br />need to be removed if a 40' wide swale were installed. Mabusth <br />estimated that many trees would need to be removed. She was <br />unable to specify the exact number. She further added that the <br />City was not in favor of this option, but would prefer the <br />underground drainage tile based on the degree of impact within <br />the lakeshore protected area. <br />Chairman Kelley expressed his preference for option 3 and <br />suggested tabling this item until further information could be <br />reviewed. Because of the urgency in resolving the runoff problem <br />before the Spring thaw, it was suggested that this matter he <br />brought directly from the March 20 Planning Commission Meeting to <br />the March 27 Council Meetinq. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Chairman Kelley, seconded by Planning <br />Commissioner Moos, to table this item until more hydraulic <br />information could be gathered by the applicant and Mr. Zuckman. <br />Mabusth indicated to Mr. Eiss that she would provide him with the <br />.•riteria needed by the City before the March 20th Planning <br />Commission Meeting.
