The <br />City Attorney has been requested to verify whether a sewer easement was <br />ever granted for this property, and if not (which would not be unusual for <br />this 1973 sewer project for which permanent easements were only <br />sporadically obtained) this might be an appropriate time to ask the <br />property owner to grant such an easement. The City would take care of all <br />of the paper work and create an appropriate legal description. <br />Staff Recommendation - <br />Based on the Planning Commission recommendation, staff would recommend <br />approval of the hardcover variance for the storage garage subject to the <br />conditions: <br />1. Storage garage shall be moved approximately 5' further south to <br />maintain a 10' setback from the existing sewer line near the north <br />line of the property. <br />2. The property owner is advisee that the existing boat house and <br />shed within the 0-75' setback zone are considered non -conforming <br />structures per the current zoning code, and are subject to the <br />pertinent codes governing such structures. <br />3. If it is determined by the City Attorney that a permanent easement <br />for the existing sewer lines has never been granted, the property <br />owner shall grant such an easement, the paperwork and legal <br />description to be provided by the City. <br />A resolution for approval besed cn the above conditions is attached <br />for Council. review. <br />- lefFerrZ C <br />
