A RESOLUTION APPROVING THE PLAT OF <br />PAINTERS MOODS <br />FILE NO. 1330 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the lags of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development of <br />land within the City; and <br />WHEREAS, the City Council has considered the application for a <br />subdivision by Fullerton Properties Inc., the subdivider; and <br />WHEREAS, on October 24, 1988, the City Council approved <br />Resolution No. 2528 granting preliminary approval for a plat at 880 <br />Townline Road; and <br />WHEREAS, the proposed plat contains seven lots, each exceeding <br />the 5.0 acre minimum lot acre requirement. Lots 2 through 6 require a <br />variance because they do not front on a public roadway. Lots 2, 4, and 5 <br />require a variance to the 300' lot width requirement as measured at the <br />rear of the 100' front yard abutting the cul-de-sac; and <br />WHEREAS, the subdivision has been found to meet all other <br />standards of the RR-lA zoning district, finding that each lot is of a size <br />and configuration that will allow its use as a single family residence to <br />be fully developed without the need of further variances; and <br />WHEREAS, all seven proposed lots are exempt from soil testing for <br />septic systems by virtue of their lot sizes exceeding 5.0 acres. However, <br />each lot has been preliminarily reviewed and is fully expected to contair <br />suitable sites for primary and alternate drainfields to serve the single <br />family residences; and <br />WHEREAS, 33' of right-of-way has been dedicated on the plat for <br />the existing Townline Road; and <br />WHEREAS, the subdivider has completed all requirements of the <br />Flatting regulations of the City, including: <br />Page 1 of 3 <br />
