376Z034 <br />(i) Lot 1, Block 1, Bayside <br />Landing Second Addition; <br />(ii) Lot 2, Block 1, Bayside <br />Landing Second Addition (the <br />Separate Access Lot); <br />(iii) Lot 1, Block 2, <br />Bayside Landing; <br />(iv) Lot 2, Block 2, Bayside <br />Landing; and <br />(v) Lot 1, Block 1, Burger's <br />Bayside Second Addition; <br />provided, however, that if any of the <br />above-described Lots hereafter shall <br />be subdivided, each buildable parcel <br />resulting from such subdivision shall <br />be and become a Lot. <br />c. "Outlot" shall mean any one <br />of Outlots A, B, C and D, Bayside <br />Landing, Hennepin County, Minnesota. <br />d. "Owner" shall mean and refer <br />to the record owner, whether one or <br />more persons or entities, of the fee <br />simple title to any Lot; provided, <br />however, that if any Lot is being sold <br />on a contract for deed pursuant to <br />which the purchaser is entitled to <br />possession of the Lot, the contract <br />for deed purchaser, whether one or <br />more persons or entities, shall be <br />considered the "Owner" of the Lot so <br />long as such contract for deed shall <br />remain in effect, provided the <br />Association shall have received a <br />complete and true copy of such <br />contract for deed. The Owner of the <br />Unplatted Parcel (or any buildable <br />parcel resulting from any subdivision <br />of the Unplatted Parcel) for purposes <br />of Paragraph 13 below shall be <br />determined in the same manner as the <br />Owner of any Lot. <br />11. The Declaration is hereby amended by adding thereto <br />the following Paragraph 13: <br />13. Association Membership and Voting <br />Rights. Each Owner of a Lot and the Unplatted <br />Parcel or any bui ldable parcel resulting from <br />-5-
