376Z034 <br />Landing, and Lot 1, Block 1, Burger's Bayside <br />Second Addition, and any permitted <br />subdivisions thereof, and for no other <br />purpose; and ownership of said Outlot C may <br />not be separated from ownership of said Lot 1, <br />Block 2, Bayside Landing. <br />8. Subparagraph d of Paragraph 9 of the Declaration is <br />hereby amended to read as follows: <br />Out lot D, Bayside Landing, shall be owned by <br />the Association and used for driveway ingress <br />and egress, drainage and utility purposes, for <br />the exclusive benefit of (i) the parcel of <br />real property described in subparagraph 9b <br />above ( the "Unplatted Parcel"); (ii) each Lot <br />except Lot 2, Block 1, Bayside Landing Second <br />Addition (the "Separate Access Lot"); and <br />(iii) any permitted subdivision of the <br />Unplatted Parcel or of any Lot other than the <br />Separate Access Lot; and for no other purpose. <br />9. The final grammatical paragraph of Paragraph 9 of the <br />Declaration is hereby amended to read as follows: <br />The restrictions on the Out lots <br />contained in this Paragraph 9 shall be <br />perpetual unless and until amended by all <br />parties who have a recorded interest in the <br />affected Out lot, with the concurrence of any <br />governmental agencies having jurisdiction. No <br />person shall be deemed to have a recorded <br />interest in Outlot D, Bayside Landing, solely <br />as a result of such person having an interest <br />in the Separate Access Lot. <br />10. The Declaration is hereby amended by adding thereto <br />the following Paragraph 12: <br />12. Definitions. The following terms <br />shall have the meanings set forth below <br />whenever used in this Declaration: <br />a. "Association" shall mean and <br />refer to Landmark Drive Homeowners <br />Association, a Minnesota non-profit <br />corporation, its successors and <br />assigns. <br />b. "Lot" shall mean and refer <br />to any one of the following described <br />parcels of real estate situated in <br />Hennepin County, Minnesota: <br />-4-
