Councilmember Nettles asked whether there <br />would technically be any impact to the wetlands due to the height <br />of the cantilevered deck? Gaf.fron answered that in his opinion, <br />Mr. McNellis's proposal would have little, if any, impact on the <br />wetlands. <br />Councilmember Nettles brought forth the issue of the lot <br />line rearrangement. Mr. MCNellis explained the ramifications of <br />proceeding in that manner, and added it would cavise enough of a <br />delay that he would be unable to build until Spring. City <br />Administrator Be-nhardson suggested that the Council grant the <br />variance for the wetland encroachment and indicate whether a lot <br />line rearrangement would be an acceptable remedy. Gaffron <br />suggested that approval be given for the application and the <br />issuance of the building permit be contingent upon the filing of <br />the subdivision application for the lot line rearrangement. This <br />would allow Mr. McNellis to begin work immediately. <br />It was moved by Councilmember Nettles, seconded by <br />Councilmember Goetten, tc approve the wetland variance and <br />require the applicant to file and follow through with a lot line <br />rearrangement application it lieu of the front setback variance. <br />Motion, Ayes-3, Nays=0, Motion passe-1. <br />11339 DAVID Lit <br />2695 CASCO POINT ROAD <br />CONDITIONAL USE PERl1IT/VARIANCE <br />RESOLUTION i2538 <br />Mr. Lee and Mr. James Robin, Mr. Lee's Landscape Architect, <br />were present for this meeting. <br />City Administrator Bernhar-3scn gave a brief synopsis of the <br />history of this application. It was determined at the last <br />Council Meeting that Mr. Lee be required to remove certain <br />timbers and fill so there will be some natural slope returned to <br />the bank. <br />Mr. Robin believed that it would be best to keep all of the <br />timbers and plant vegetation that would eventually screen the <br />wall fr^m view. He said that he could not guarantee the same <br />kind of stability and screening by following the City staff's <br />recommendations. He asked that the Council reconsider their <br />decision to follow the Citv t:ngineer's r-(-ommen,?aeons and try to <br />rea,.-h another compromise. <br />Acting Mayor Peterson Stated that- she would be in(-1 :ned co <br />stay with the City Engineer's recorrmendal—i—ns. Councilmember <br />Nettles concurred, and added 'hat he. actui l 1%, was leaning more <br />toward total restoration of the bank. However, since the project <br />was already completed, he felt that the City Engineer's <br />recommendations were a compr,)rr;ise.
