MINUTES OF THE ORONO COUNCIL MEETING OF NOVEMBER 14, 1988 <br />ZONING FILM 01347-MICKARL HALLEY HOMES CONTINUED <br />Councilmember Goetten asked for the hardship in this case. <br />Mrs. Terry and Mr. Martinson explained why they felt there was a <br />need to keep trespassers out. The main issue was the loss of <br />privacy. Goetten stated that there has been a lot of difficultN <br />establishing appropriate guidelines for fences. She felt this <br />was mainly due to the fact that citizens of Orono did not want <br />the fenced -in, confined atmosphere. She questioned whether the <br />City staff needed to take a comprehensive look at the issue of <br />fencing. City Administrator Bernhardson acknowledged Goetten's <br />concerns and said that he would be happy to proceed accordingly. <br />Acting Mayor Peterson asked Mr. Martinson if the gate could <br />be moved back so that a variance would not be required? Mr. <br />Martinson replied that he preferred to crowd the front property <br />line as much as possible. There would be a possibility of <br />trespassers going around the gate should it be moved back. <br />Further, the Terry's property line is very defined and it would <br />be better, from a security standpoint, to place the gateway where <br />the property begins. <br />Councilmember Nettles expressed h.s opinion to be that the <br />gateway was a convenience for the applicant, but not much else. <br />He did not believe that there would be enough trespassing traffic <br />to warrant the need for such security measures. He did not feel <br />there was an adequate hardship for the variance for the gate. <br />Acting Mayor Peterson reiterated Councilmember Goetten's <br />suggestion of looking at the fencing issue as a whole. She said <br />that she would be inclined to approve this application, <br />especially in light of the fact that she had approved similar <br />applications in the past. <br />It was moved by Councilmember Goetten, seconded by Acting <br />Mayor Peterson, to adopt Resolution 02539, approving the 10' <br />setback variance and height variance for Michael Halley_ Homes. <br />Motion, Ayes-2, Nettles, Nay, Motion passed. <br />MAYOt'S ' RPORT2 <br />Thee was no Mayor's report for this .aeetinq. <br />CITY ADMINISTRATOR'S REPORT: <br />LIQUOk LICENSE RENEWALS <br />City Administrator Bernhardson explained that the liquor <br />licenses for Jimmies Lounge and Navarre Liquor were cominq up for <br />renewal January 1, 1989. There have teen concerns with the on - <br />sale operation. However, there have not been any charged <br />violations. staff is recommendinq that the license holder be put <br />on more stringent notice and if there were direct violations for <br />which charges were issued, the matter would be brought before the <br />Council. <br />t+ <br />
