Garbage, rubbish <br />and trash shall not be kept on any Lot, except in clean and sani- <br />tary containers in the garage of the townhome located on such <br />Lot. <br />Section 9. Nuisance; Illegal Activities; Variation. <br />Nothing snail be done or kept on the C:rimcn Area or on any Lot or <br />on any part thereof which would (i) increase the rate of <br />insurance on anv other Lot over what the Owner of such other Lot <br />or the Association, but for such activity, would pay, without the <br />prior written consent of the Association, or (ii) which would be <br />in violation of any statute, rule, ordinance, regulation, permit <br />or other validly imposed requirement of any governmental body. <br />No damage to, or waste of the Properties or the buildings situ- <br />ated thereon shall be committed by any Owner or any invitee of <br />any Owner and each Owner agrees to indemnify and hold harmless <br />the Association and the other Owners from and against all loss <br />resulting from any such damage or waste caused by him or by his <br />invitees. No noxious, destructive or offensive activity shall be <br />allowed on the Common Area or on any Lot, nor shall anything be <br />done thereon, either willfully or negligently, which may be or <br />may become an annoyance or nuisance to any other Owner or to any <br />other person at any time lawfully residing on the Properties. <br />Section 10. Setbacks. <br />(a) The recorded plat of MEYERS WOODS public utility <br />and drainage easements have been dedicated along the perimeters <br />of all lots (*** certain lots? ***l. Within said easement areas <br />no houses or other improvements shall be built that would inter- <br />fere with utilities or drainage. <br />(b) Ordinances of the City of Orono prohibit con- <br />struction of buildings within the front 50 feet, rear 50 feet and <br />side 30 Feet of each Lot. Said ordinances may be changed by the <br />City Council. For this purpose, front, rear and side yard set- <br />backs are measured pursuant to municipal ordinances. <br />(c) in addition tc the setbacks described in subsec- <br />t_ons (a) and (b), no clear_ng, grading or constr•-icticn shall be <br />conducted within the front 25 feet, rear 25 Feet an; side 10 feet <br />of each Lot.
