Zoning File #1728 <br />April 30, 1992 <br />Page 4 <br />Additional Exhibit <br />J - Sewer Easement Filed Against Lot 15, Block 14, <br />Minnetonka Bluffs <br />Additional Comments and Planning Commission Recommendation <br />The City Attorney's office has provided confirmation that <br />the required sewer easement has been granted via Lot 15 to the <br />immediate south of the subject property. Review Exhibits E and <br />J. There is no need to acquire additional easements from the <br />applicant. <br />Mr. Jaffray advised the City of the difficulty of legally <br />combining the remaining three parcels with his homestead property <br />as one of the parcels is torrens. Staff noted that based on the <br />homestead properties alone, lot coverage would be maintained at <br />8.6% where the ordinance would allow up to 15%. The Planning <br />Commission agreed with applicants request and the legal <br />combination was not required. Staff has drafted the resolution <br />such that the special relationship of the six lots has been <br />recognized as property is substandard in area (total area at <br />38,700 s.f.) and property is located in a two acre zoning <br />district requiring 87,120 s.f. <br />The applicant agreed with both Planning Commission members <br />and staff that the existing garage is in a hazardous condition <br />and should be removed. The Planning Commission conditioned <br />approval on the existing- garage at the east side lot line being <br />removed within 30 days of the Building Inspector's final <br />inspection. <br />The enclosed approval resolution has been drafted per the <br />Planning Commission's unanimous approval of the Jaffray's setback <br />variance application. <br />lsv <br />
