Zoning File #1728
April 30, 1992
Page 4
Additional Exhibit
J - Sewer Easement Filed Against Lot 15, Block 14,
Minnetonka Bluffs
Additional Comments and Planning Commission Recommendation
The City Attorney's office has provided confirmation that
the required sewer easement has been granted via Lot 15 to the
immediate south of the subject property. Review Exhibits E and
J. There is no need to acquire additional easements from the
applicant.
Mr. Jaffray advised the City of the difficulty of legally
combining the remaining three parcels with his homestead property
as one of the parcels is torrens. Staff noted that based on the
homestead properties alone, lot coverage would be maintained at
8.6% where the ordinance would allow up to 15%. The Planning
Commission agreed with applicants request and the legal
combination was not required. Staff has drafted the resolution
such that the special relationship of the six lots has been
recognized as property is substandard in area (total area at
38,700 s.f.) and property is located in a two acre zoning
district requiring 87,120 s.f.
The applicant agreed with both Planning Commission members
and staff that the existing garage is in a hazardous condition
and should be removed. The Planning Commission conditioned
approval on the existing- garage at the east side lot line being
removed within 30 days of the Building Inspector's final
inspection.
The enclosed approval resolution has been drafted per the
Planning Commission's unanimous approval of the Jaffray's setback
variance application.
lsv
