City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1 558 <br />8. The setback of the proposed garage is consistent with <br />!setbacks of existing garages on Baldur Park Road. <br />9. There is no traffic hazard or danger created in the public's <br />continued use of Baldur Park Road if a garage remains located on <br />the opposite side of the street from the principal residence or <br />from all other garages located on the north/opposite side of <br />Baldur Park Road. <br />10. The City Council has considered this application including <br />reports by City staff, comments by the owner and other <br />interested persons, and -he effect of the proposed variances on <br />the health, safety and welfare of the community. <br />11. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning dirstrict: that granting the variances <br />would not adversely effect traffic conditions, light, air not <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to t.-e owner, but i s necessary to <br />alleviate ademonstrable hardship ordifficulty; is necessary to <br />preserve a substantial property right of the owner; and would be <br />in keeping with the spirit and intent of the zoning code and <br />comprehensive plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Oronj City Council hereby ge-ants a <br />variance to zoning Ordinance Sections 34.552 and 34.510 for <br />construction of a 24' X 22' detached garage on property legally <br />described above to be located 10 feet from the front/street property <br />line instead of the required 30 feet and 25 feet from the lakeshore <br />instead of the required 75 feet sub-ject to the following conditions: <br />1. Gravel parking are—i on L(,t. 8 to be rt.-moved at the time the <br />appl ic,,nt removes the ex i.st ing gar aje un Lots 17 and 18. <br />2. A demol i tion permit must be obtained by the applicant for the <br />removal of the existing garage on the property. <br />3. Anydoors over .3 feet. wide shall face away from the street with <br />a turnaround provided c.,n the property. <br />4.
