MEETING OF THE ORONO COUNCIL, SEPTEMBER 12, 1983. PAGE 5 <br />k5 GUENTHER ROTH <br />428 BALDUR PARR RD <br />ARIANCE <br />Guenther Roth, George Stodola and Mr. Roth' sattorney <br />was present. Zoning Administrator Mabusth reviewed <br />with the Council the history of the applicatidn. <br />Mabustt, noted that in 1982 the applicant came in with a <br />proposed garage 52' x 2.5' garage, two story structure <br />to be placed on Lots 17 & 19. Mabusth stated that <br />Planning Commission said that it was too large and gave <br />the applicant specific directives to follow which Mr. <br />Roth did to the letter . Mabusth stated that Mr . Roth <br />came back in 1983 with a revised plan following the <br />Planning Commission's direction and Mr. Roth was <br />denied. Mabusth noted that staff is recommending <br />against the most recent Planning Commission's <br />recommendation and asked Council to revert back to the <br />1982 Planning Commission direction which allowed the <br />garage to be located on Lots 17 & 19. <br />Mr. Roth stated that he is taking away an existing eye <br />sore and needs the garage now for storage on Lots 17 and <br />18. <br />Councilmember Adams stated that he had no problem but <br />warned the applicant that all three lots are <br />considered together when considering hardcover for <br />any future applications. <br />Zoning Administrator Mabusth stated that Mr. Roth's <br />other concern was with the Planning Commission's <br />recommendation that no e hardcover allowed on this <br />property. <br />Councilmember Frahm stated he had no problem but that <br />the odds of getting any more hareicover approved cn the <br />property is slim. Frahm stated that he considered <br />this more of a wetlands than lakeshore which the <br />requirement is 25' from any wetlands and that Mr. Roth <br />is proposing 24' which is ok. <br />Councilmember Frahm mjved, Councilmember Adams <br />seconded, to approve a new garage in place .;f 'he <br />existing garage to be placed on Lcts 17 & 18 subie . <br />the following condition: <br />1. Gravel to he removed on Lot 8 and seeded. <br />2. All roof drainage to be directed away from lake. <br />3. Structure may never be used as a separate dwel ling <br />unit. <br />4. Detached garage on Lots 17 s 18 to be placed 10 feet <br />off Baldur Park Road right of way with dc.urs facing <br />away frum street and turnaround provided on <br />private property. <br />
