The City Counril has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the owner and other interested <br />persons, and the effect of the propc-ed variances on the health, <br />safety and welfare of the community. <br />0;. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district: that granting the variances <br />would not adversely effect traffic conditions, light, air nor <br />pose a fi re hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the owner, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the owner; and would be <br />in keeping with the spirit and intent of the zoning code and <br />comprehensive plan of the City. <br />CONCLUSIONS, OROER ANn CONnITIONS <br />Based upon the above findings, the Orono Ci'y Council hereby grants <br />variances to Sections 14.552 and 'AR.201 to allow construction of a 24' x <br />22' detached garage on the property legally described above to be <br />located 5 feet from the interior/side property line instead of the <br />required 10 feet and 10 feet_ from the street property line instead of <br />the required 101 feet. And to allow a 14% increase of hardcover over the <br />Allowed 1,024 square feet or 25% within the 75 feet to 2.50 feet <br />lakeshore sethAck area subject to the following conditions: <br />1. All improvements for the property Are limited to a 14• <br />increase in hardrover within the -15 feet to 250 feet setback area. <br />2. The doors of the detached garage must face Away from the <br />street with turnaround provided on the property. <br />1. No r,ther variances Are granted or permitted for this <br />structure. <br />4. The City will approve no future variances for this property. <br />S.
