Mabusth, Building & Zoning Administrator <br />Date: March 11, 1996 <br />Subject: #2117 Thomas McCune, 1473 Bay Ridge Road - Conditional Use Permit/Variance - <br />Public Hearing <br />Zoning District: LRAA <br />Total area = Approximately 35,900 s.f. <br />Application: Applicant has filed a conditional use permit to permit the installation of a two -tiered <br />retaining wall at County road right-of-way line. 24 lineal feet of a two -tiered timber <br />wall exists at the north lot line. Applicant wishes to extend retaining wall an <br />additional 90 lineal feet to south. Major portions of the wall are located within the <br />75' setback of the lake requiring setback and hardcover approvals. <br />Pertinent Ordinances <br />1. Section 10.03, Subdivision 19 - A conditional use permit is required for the installation of <br />retaining walls. <br />2. Section 10.22, Subdivision 1 (B) - Lakeshore setback variance for retaining wall. <br />Required = 75' <br />Proposed = 69' <br />Variance = C or 8% <br />3.
