Y7 � . . <br /> /.. �!' <br /> �',� G'�' RESOLUTION OF THE CITY COUNCIL <br /> L`�kEsKo4`� rvo. 4 g l. � � <br /> • k) All trails and sidewalks, whether public or private, shall be installed <br /> . concurrently with the residential development phases and prior to occupancy <br /> of residential units. <br /> 1) Maintenance responsibility for the sidewalks within the right-of-way of Kelley <br /> Parkway shall be the responsibility of the Developer or the homeowners or <br /> commercial maintenance association(s). <br /> 4. Utilities and Stormwater Management <br /> a) Developer shall construct municipal sewer and water lines as shown on Sheets <br /> C4.1 through C4.6, subject to final design detail approval by the City <br /> Engineer. The Developer shall provide a 12-month warranty on all utility <br /> construction. . <br /> b) The Citywill own and maintain the sanitary sewer and water mains within the <br /> • development. The City will inspect these systems during their construction <br /> to ensure proper installation. Developer shall grant Drainage and Utility <br /> Easements to the City of Orono over all municipal sewer and water lines and � <br /> � facilities, including the rights of way necessary to maintain same. <br /> c) Applicants' architect shall submit final development plans to the Metro <br /> Council Environmental Services to determine the exact number of SAC units <br /> to be charged at the time of the issuance of building permits. <br /> d) Developer shall construct stormwater management facilities as shown on the <br /> approved plans,Sheets C4.7 through C4.12.'The stormwater drainage system <br /> will be owned and maintained by the homeowners association. <br /> e) Developer shall construct a regional stormwater pond within Outlots B and � <br /> C and within the MnDOT right-of-way per the designs and specifications as <br /> shown on Sheet C4.12, subject to Developer obtaining the appropriate <br /> permits for such use from MnDOT. The regional pond is intended to <br /> accommodate stormwater runoff from the development as well as for the <br /> entire upstream watershed. The regional stormwater pond shall be maintained . <br /> by the Developer during all phases of development,after which the Stonebay <br /> Community Association shall be responsible for maintenance. In the event <br /> that MnDOT approvals require that the City be responsible for maintenance <br /> • of the regional stormwater pond, the aforesaid Association shall accept the <br /> financial obligation for such maintenance. <br /> Page 9 of 18 , <br />
