CITY of ORONO <br /> ,� � ;�.� ti <br /> '''�'� � 'j G�' <br /> RESOLUTION OF THE CITY COUNCIL <br /> L'�kEsH.og'� � No. � � � � <br /> by the applicants and the effect of the proposed variances on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER,AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Code Section 10.22, Subdivision 1(B) and Section 10.56, <br /> Subdivision 16(C)(6)to permit an encroachment of 42' to construct a new residence on the <br /> property and 62' to construct a lakeside pool into the average lakeshore setback; and a <br /> conditional use permit to allow land alteration of greater than 500 cubic yards to be brought onto <br /> the site per Section 10.03, Subdivision 19. Approval is subject to the follo�ving conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant attached to <br /> this resolution as Exhibit A. Any amendments to the site plan may require <br /> • further Planning Commission and City Council review. <br /> � 2. The applicant shall submit a final grading plan to City Engineer for review prior <br /> � to issuance of the building permit. <br /> 3. The applicant shall obtain a land alteration permit from the city prior to hauling � <br /> fill to the site. <br /> 4. The applicant must contact Minnehaha Creek Watershed District for an erosion <br /> control permit. <br /> 5. Erosion control measure shall be taken by installing a silt fence around the <br /> construction area upon receiving permit from City and MCWD and prior to any � <br /> land alteratiori activity. Applicants and their contractors shall follow the"Best � <br /> Mana�ement Practices for Protection of Water Quality in Urban Areas." <br /> 6. A route map shall be provided to the city prior to the start of construction showing <br /> which county/city street are to be used. <br /> 7. The applicant shall televise the sewer between the north and south lot lines prior to <br /> any grading activity and again after the proj ect is complete. <br /> • Page 3 of 7 <br />
