The Planning Commission made the following findings of fact: • <br /> A. The proposed residence is set further from the lake than the old residence. <br /> B. The lot and adjacent lots are heavily wooded. <br /> - C. The proposed residence and lakeside pool will not obscure neighboring <br /> properties views. <br /> D. The proposed residence meets hardcover, lot coverage by structures and <br /> � height requirements. <br /> E. The sewer line prohibits the proposed residence from being located further <br /> • . back on the property(towards the road). <br /> 5. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances would not adversely affect traffic conditions, light, air,nor pose a <br /> - fire hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants,but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. . <br /> 6. The City Council finds that granting a conditional use permit to allow land alteration <br /> � of more than 500 cubic yards of fill to be brought onto the property will not to be <br /> detrimental to the health,safety or general welfare of the public,would not adversely � <br /> affect light, air nor pose a fire hazard or other danger to neighboring properties,nor <br /> ' will it depreciate surrounding property values and that the proposed level of use of <br /> the property will be in keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> ' • 7.
