A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (C) AND <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1318 <br />WHEREAS, Suad H. Azhari (hereinafter "the applicant") has an <br />interest in the property located at 1745 Fox Street within the City of <br />Orono (hereinafter "City") and legally described as the Southwest quarter <br />of the Southeast quarter of Section 3, Township 117N, Range 23 West of the <br />fifth principal meridian, Hennepin County, Minnesota (hereinafter "the <br />property") ; and <br />WHEREAS, the applicant has applied to the City for variances to <br />Municipal Zoning Code Section 10.03, Subdivision 15 (C) and Section 10.28, <br />Subdivision 5 (B) to permit the installation of a entrance gate to tze <br />property requiring a height variance of 4�' or 128% at a maximum hc,`_ght of <br />8' where only 3h' would be allowed and a setback variance of 39.7' or 78% <br />for the gate structure set 10.3' from the front/street lot line instead of <br />meeting the .required 50' setback. <br />MinnFsota: <br />NON, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1318. <br />2. The property is located in the RR-lB Single Family Rural <br />Reside::Lial Zoning District requiring 2 acres in area. The property <br />consists of 25 acres. <br />3. The Orono Planning Commission reviewed this application on August <br />15, 1988 and recommended approval of the proposed variances based upon <br />the following findings: <br />A) The gate/post otructure does not create a potential hazard <br />for the users of the public roadway nor of the private driveway <br />because of the 30' setback from the travelled roadway. <br />B) The gate shall provide clearance for emergency veh Iles that <br />may have to service the property. <br />C) The qate structure will provide the necessary security for <br />the very secluded property. <br />Page 1 of 4 <br />r <br />
