14ember John Maresh introduced the following Resolution and moved its adoption: <br />RESOLiJTION AUTHORIZING COMPROMISE AND SETTLEMENT OF ACTION <br />ACQUIRING CERTAIN PROPERTY BY PROCEEDINGS IN EMINENT DOMAIN <br />WHEREAS, on July 13, 1988, the School District and Woods <br />Academy, Inc. stipulated to and the Hennepin County District <br />Court entered an Order finding the taking of Woods Academy's <br />interests in the School District's Maple Plain Elementary School <br />site to be necessary, for a public purpose, and authorized by <br />law, and such Order further provided for the transfer of title <br />to and possession of the property by the School District as of <br />August 19, 1988; and <br />WHEREAS, On July 13, 1988, Woods Academy delivered to the <br />School District notice of its intent to exercise a right of <br />option to purchase under the lease; and <br />WHEREAS, the parties intend to reach an agreement regarding <br />the amount of compensation to be paid to Woods Academy for the <br />settlement of all its claims against the School District. <br />NOW, THEREFORE, BE IT RESOLVED by the School Board of <br />Independent School District No. 278 as follows: <br />1. That the Chairperson and Clerk of the Board be <br />authorized and directed to execute on behalf of the School Board <br />the attached Stipulation of Settlement which is incorporated <br />herein by reference. <br />The motion for the adoption of the foregoing Resolution was <br />duly seconded by Member Lucie Taylor and upon vote <br />being taken thereon, the following voted in favor thereof: <br />Kitty Crosby, John Maresh, Lucie Taylor, Jim Franklin, Don Anderson, <br />Dave McKown <br />ani the following voted against tht same: <br />None <br />whereupon said Resolution was declared duly passed and a.lopted. <br />
