Standards for floodway conditional uses. <br />(a) All uses. No structure (temporary or permanent), fill (including fill for <br />roads and levees), deposit, obstruction, storage of materials or equipment, or other uses <br />may be allowed as a conditional use that will cause any increase in the stage of the 100- <br />year or regional flood or cause an increase in flood damages in the reach or reaches <br />affected. <br />Sec. 78-1288. Hard cover limitations. <br />(a) No hard cover or impervious surface shall be placed, located or constructed within 75 <br />feet of the ordinary high water level of any lake or tributary, except for stairways, lifts, <br />landings and lockboxes as regulated elsewhere in this Code. <br />(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than 25 percent <br />hard cover. Between 250 feet and 500 feet of the OHWL there shall be no greater than 30 <br />percent hardcover. Between 500 feet and 1,000 feet of the OHWL there shall be no <br />greater than 35 percent hardcover. <br />Sec. 78-1403. Lot coverage. <br />In all zoning districts, for all lots of 0--1.99 acres in total area, the total combined <br />footprint areas of all principal and accessory structures shall not exceed 15 percent of the <br />lot area. The lot is <br />substandard in width and area and the application of the 7 5' lake setback allows for only <br />about 40' of buildable area depth. The applicant is proposing a 1,495 s.f. home and <br />minimal hardcover to support the home. The application includes lot area, lot width, and <br />lake yard setback as well as hardcover variances. Additionally, a conditional use permit <br />to conduct land alterations within the 100-year flood elevation (931.5') is requested. <br />2
