A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 i 2 <br />FILE #1320 <br />WHEREAS, Dr. & Mrs. Robert Brandenburg (hereinafter "the <br />applicants") are the owners of the property located at 719 Minnetonka <br />Highland Lane within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lot 7, Block 2, Minnetonka Highlands Estates, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance <br />to Municipal. Zoning Code Section 10.22, Subdivision 1 to permit the <br />construction of a deck and screen porch which will constitute an <br />encroachment into the required average lakeshore setback zone where no <br />encroachment is normally allowed, and a variance to Section 10.22, <br />Subdivision 2 to allow hardcover in the 75-250' setback zone in excess of <br />the 25% hardcover normally allowed. <br />Minnesota: <br />NON, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1320. <br />2. The property is located in the LR-lC Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on August <br />15, 1988 and recommended approval of the proposed variances based upon <br />the following findings: <br />A) The proposed construction replaces an existing deck and <br />screen porch which were constructed when the house was built in <br />the 1970's. The existing deck was not constructed of treated <br />materials, and is in poor condition, hence the replacement of the <br />deck is partially for safety purposes. <br />B) The proposed deck and screen porch are similar in size and <br />character to the existing deck and porch, and will encroach no <br />further into the %verage lakeshore setback than the existing <br />structures. No !xisting lake views enjoyed by neighboring <br />property owners will be encroached on by this construction. All <br />work is in the 75-250' lakeshore setback zone. <br />Page 1 of 4 <br />
