§ 10.03 <br />Subd. 23. Permit Required. The requirements of Subdivision 19 are not intended <br />to govern the normal and customary rip-rap of lakeshore property. It is unlawful for any person to <br />rip-rap lakeshore property within the limits of the City without a permit issued by the City Engineer. <br />Any unusual rip-rap shall be referred by the City Engineer to the Planning Commission and the <br />Council for action in accordance with this Chapter. · <br />Source: Ordinance No. 167 <br />Effective Date: 6-25-74 <br />Subd. 24. Application for Permit. An application for such permit shall be accompanied <br />by a drawing showing the location of the proposed rip-rap and such other information as the City <br />Engineer may require from time to time. Applications shall be filed with the City Administrator and <br />shall be accompanied by a fee in the amount prescribed by the current City fee schedule payable to <br />the City. <br />Source: Ordinance No. 196 <br />Effective Date: 8-22-77 <br />Subd. 25. Mining. The commercial extraction of sand, gravel, or other material from <br />the land and removal thereof from the site without processing shall be mining. In all districts the <br />conduct of mining shall be permitted only upon issuance of a condi-tional use permit. Such permit <br />shall include, as a condition thereof, a plan for a finished grade which will not adversely affect the <br />surrounding land or development of the site on which the mining is being conducted, and the route <br />of trucks moving to and from the sites. A bond will be required for restoration. <br />Subd. 26. Soil Processing. The operation of processing of sand, gravel, or other material <br />mined from the land shall be permitted only by conditional use permit. Such conditional use permit <br />shall include a site plan where the processing is to be done, showing the location of the plant, <br />disposal of water, route of trucks moving to and from the site in removing processed material from <br />the site, the condition in which the site is intended to be left upon completion, hour of operation, and <br />such permit shall not be granted for a period oflonger than twelve (12) months. <br />Source: Municipal Code <br />Effective Date: 9-14-67 <br />Subd . 27. Special Standards for Back Lots Created After January 1, 1994. Back lots <br />as defined in this section which were created as part of a subdivision that received preliminary <br />subdivision approval after January 1, 1994 are subject to the following special requirements in <br />addition to the standards required in Section 11.31, Subdivision 5 of the Orono Subdivision Code: <br />A.
