The only potentially affected neighboring properties are two homes located approximately 200' south of the site, which are significantly separated from the parking lot so as to minimize any real impacts; and a home to the west with significant separation and screening from the church buildings and parking areas. Staff has not received any comments from neighboring property owners. 14. The church is proposing to construct an accessory detached storage building up to 200 s.f. in area to be located generally southwest of the main church building. Such structure must be located at least 50' from property boundaries. 15. The Orono Planning Commission reviewed this application on July 21, 2003 and recommended approval as proposed on a vote of 7 to 0. 16. The City Council finds that granting a conditional use permit for continued use of the property for a church use will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 17. The City Council has considered this application including the findings and recommendations of the Planning Commission,reports by City Staff, comments by the applicant and the effect of the proposed conditional use permit on the health, safety and welfare of the community. CONCLUSIONS, ORDER,AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Sections 10.28, Subdivision 3(A) and 10.20, Subdivision 3(B)to permit a church use on the property located at 865 Ferndale Road North,subject to the following conditions: Page 4 of 7
