"'he City Council has considered this application including the <br />fin, .ngs and recommendations of the Planning Commission, reports by <br />st of f and comments of the al.p 1 icant and the of feet of the proposed use <br />on the health, safety and welfare of the community. <br />5. The City Council finds that granting a Conditional Use Permit that <br />would formally recognize the existing caretaker and summer cabin use <br />on the property will not be detrimental to the health, safety or <br />general welfare of the public, would not adversely affect light, air <br />nor pose a fire hazard or other danger to neighboring properties, nor <br />will it depreciate surrounding property values and that the proposed <br />level of use of the property wil l be in keel:ine,, with the intent and <br />obj,tctives of the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a Conditional Use Per.nit per Municipal Zoning Code <br />Section 10.24, Subdivision 3 (A) that would formally recognize the existing <br />caretaker unit and summer guest caLin on the property so that applicant <br />will be allowed to reconstruct a new principal residence on the property, <br />rjbject tc the following conditions: <br />1. The caretaker unit is not approved for rental use, but for the <br />exclusive use of caretaker or hired help of the owners of the <br />property. <br />2. The guest cabin shall be for the exc 1 usi,.a use of the members o: <br />the family of the owner of the principal residence and is not approved <br />for rental uso. <br />3. All new construction shall be subject to the ordinances of the <br />City that govern the development of lakeshore property. <br />4. Violation of or non-compliance with any of the terms and condi- <br />tions of this resolution shall constitute a violation of the zoning <br />code, shall automatically terminate any authority granted herein, and <br />shall be punishable as a misdemeanor. <br />I The undersigned applicant has read, understood and hereby agrees <br />to the terms of this resolution and on behalf of himself, his heirs, <br />successors and assigns, hereby agrees to the recording of this <br />resolution in the chain of title of the property. <br />Page 2 of 4 <br />
