The Duff's have a bad sewer <br />problem now but that has nothing to do with the merits <br />of the plat. <br />Mabusth noted that 1 lot has riparian rights via an <br />outlot and anuther would have access on both Brownri <br />and Tanager Bays but must be limited t.) a sin -Ile access. <br />Owner can be given a choice. <br />Planning Commission alsc felt that just 1 dock and l <br />access would be allowed on Outlot A. <br />Berg noted that the Council has already filet: a plat. <br />of County Road 15. <br />Callahan moved to deny the two variances needed for this <br />subdivision to be approved but to table all other issues <br />so Berg can confer with his clients as to whether they <br />want to continue with the subdivision or not. <br />McDonald seconded. Vote: Ayes (7), Nays (0). <br />Applicant was present. Applicant noted that a family of <br />four had moved in since the last meeting ana that the <br />septic system was working fine. He also noted a letter <br />from the previous owner which stated that they had put in <br />a new drainfield in June, 1976, and had it pumped in <br />October and November. Elmer J. Peterson 6 Company <br />had suggestei that they pLmp it before the cold winter. <br />Ile noted that his proposal is an increase of 240 sf. <br />The addition being 8' x 3)', which would to an expansion <br />of the living room and bedroom. <br />Callahan noted that this was almost a 100% variance to <br />be granted. <br />Opheim felt the applicant had sufficient hardships. <br />Opheim moved to approve an 8' x 30' addition for Doug <br />DeMalignon involving expansion of an existing bedroom <br />and living room to the principal 4tructure at 1380 Arbor <br />Street based on the following findings and hardships: <br />1 - No additional land available. <br />2 - Established residence for over 50 years. <br />s - Expansion will create no additional 1enands on <br />existing substandard septic system. <br />GREGORY/DUFF CONT. <br />DOUG DeMALIGNON <br />1380 Arbor Street <br />Variance <br />f681 <br />
